Who we are
PhotoNest is a sole-trader business operated by Phillip Dewey, based in Cardiff, Wales, United Kingdom. For the purposes of these Terms, “PhotoNest”, “we”, “us” and “our” mean Phillip Dewey trading as PhotoNest. Service of notices: send to legal@photonest.co.uk.
What you're paying for
A single PhotoNest order (Basic or Premium) buys you one end-to-end run of our organisation pipeline against the photo library you upload, plus continued access to the resulting organised library while your account is active. A Living Album subscription buys you a monthly photo upload allowance and rolling library hosting; it renews each month until you cancel.
Acceptable use
Don't upload illegal content. In particular, child sexual abuse material (CSAM) is reported to the relevant authorities without notice. We use industry-standard safe-search and image hashing to detect this category. Beyond illegal content we don't moralise about your photos.
Refunds
Every PhotoNest order carries a 14-day money-back guarantee from delivery — if you're unhappy with the organised library, email hello@photonest.co.uk and we'll refund in full. Living Album subscriptions renew each calendar month and can be cancelled any time from your account page; cancellation takes effect at the end of the current billing period, and you keep access to everything already in your library.
Liability
We back up your organised library but recommend you keep your originals elsewhere too — PhotoNest is not a substitute for primary backup. To the extent permitted by law, our aggregate liability is capped at the amount you've paid us in the 12 months before the event giving rise to the claim. Nothing in these terms limits any liability that cannot lawfully be limited (e.g. death or personal injury caused by negligence).
Changes
We'll email you at least 30 days ahead of any material change to these terms. Continued use after that period is acceptance of the updated terms.
Governing law
These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except that consumers resident in the EU may bring proceedings in their own jurisdiction where consumer-protection law requires.
